Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of Trackable - Order Status ("the App", "Service"), a Shopify application operated by Sovi Apps ("we", "our", or "us"). By installing or using the App, you agree to be bound by these Terms.

2. Service Description

Trackable is a Shopify application that provides merchants with a customer-facing order tracking page. The App allows your customers to look up their order status by entering their email address or phone number and order number. The App retrieves order and fulfillment data from Shopify and displays tracking results including shipment status, carrier tracking information, a delivery progress timeline, order items, pricing, and a shipping address map.

3. Account and Eligibility

  • You must have a valid Shopify store to use the App
  • You must install the App through the Shopify App Store
  • You are responsible for maintaining the security of your Shopify account
  • You must be at least 18 years of age or the age of majority in your jurisdiction

4. Subscription Plans and Billing

Free Plan

The Free plan includes up to 100 order lookups per calendar month at no cost. All features are included.

Pro Plan

The Pro plan provides unlimited order lookups at $9.99 USD per month. Billing is handled through Shopify's billing system. By exceeding the free tier, you authorize the recurring charge through your Shopify account.

Billing Terms

  • All charges are billed through Shopify and appear on your Shopify invoice
  • Usage resets on the first day of each calendar month
  • You may cancel your subscription at any time through the App's billing page
  • No refunds are provided for partial months of service

5. Acceptable Use

You agree to:

  • Use the App only for its intended purpose of providing order tracking to your customers
  • Not attempt to reverse-engineer, decompile, or disassemble the App
  • Not use the App in any way that violates applicable laws or regulations
  • Not interfere with or disrupt the App's functionality or servers
  • Not use the App to collect or process data beyond what is necessary for order tracking

6. Data and Privacy

Our collection and use of data is governed by our Privacy Policy. By using the App, you acknowledge and agree to our data practices as described therein. You are responsible for ensuring that your use of the App complies with all applicable privacy laws in your jurisdiction, including obtaining any necessary consent from your customers.

7. Third-Party Services

The App integrates with the following third-party services to provide its functionality:

  • Shopify: For order data retrieval, page management, billing, and authentication
  • Mapbox: For geocoding shipping addresses and displaying map imagery on the tracking results page
  • Neon PostgreSQL: For data storage
  • Vercel: For application hosting

Your use of the App is also subject to the terms of service of these third-party providers. We are not responsible for the availability, accuracy, or actions of third-party services.

8. Intellectual Property

The App, including its code, design, functionality, and documentation, is the intellectual property of Sovi Apps. You are granted a limited, non-exclusive, non-transferable license to use the App in connection with your Shopify store for the duration of your subscription.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

  • The App will be uninterrupted or error-free
  • Tracking information will always be accurate or up-to-date (tracking data depends on carriers and Shopify)
  • Map imagery will always be available or accurate (depends on Mapbox and address quality)
  • The App will meet all of your specific requirements

10. Limitation of Liability

To the maximum extent permitted by applicable law, Sovi Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct or content related to the App
  • Inaccurate tracking information provided by shipping carriers

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Sovi Apps, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or your violation of these Terms.

12. Termination

  • You may stop using the App at any time by uninstalling it from your Shopify store
  • We may suspend or terminate your access to the App if you violate these Terms
  • Upon termination, all data associated with your account will be deleted in accordance with our Privacy Policy

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
